REAL8 Terms of Service
1. Acceptance of Terms:
By acquiring, using, or interacting with REAL8, you agree to be bound by these Terms of Service.
2. Description of REAL8:
REAL8 is a crypto-asset on the Stellar network. The REAL8 Project is a movement to enable financial inclusion and provide educational opportunities in underserved communities all around the globe.
3. Acquisition of REAL8:
The acquisition of REAL8 will be done through exchange platforms, digital wallets, etc. in accordance with the applicable laws and regulations in your jurisdiction.
4. Using REAL8 :
You may use REAL8 to make transactions, participate in projects, etc. You are prohibited from using REAL8 for illegal activities or activities that infringe third party rights.
5. Associated Risks :
Investing in cryptocurrencies, including REAL8, involves inherent risks, such as price volatility, regulatory risks, and security risks. You acknowledge and accept these risks.
6. Intellectual Property :
All intellectual property rights related to REAL8 and its promotional materials belong to Rafael Minuesa.
7. Limitation of Liability:
REAL8 shall not be liable for any direct or indirect loss arising from your use of the website or any interruption in its operation.
8. Indemnification:
You agree to indemnify and hold REAL8 harmless from any claim or demand arising from your use of its website.
9. Modification of Terms:
These Terms of Service may be modified at any time, as required by circumstances, or the legal requirements of each country.
10. Applicable Law and Jurisdiction :
These Terms of Service shall be governed by and construed in accordance with the laws of each country.
11. Severability :
If any provision of these Terms of Service is held to be invalid or unenforceable, the remaining provisions will remain in effect.
12. REAL8 Wallet and REAL8 API
These Terms also apply to the REAL8 Wallet at https://app.real8.org and to the REAL8 API at https://api.real8.org, including when they are reached through other software, such as the REAL8 Gateway plugin for WooCommerce. Both are services of the REAL8 Project, which is sponsored by Asociación Hispanopedia, a non-profit association registered in Spain.
12.1 The REAL8 Wallet
The Wallet is software that runs in your browser and lets you manage your own account on the Stellar network. A secret key that you create or import in the Wallet is kept on your device and is not sent to our servers. We cannot see it, recover it or reset it. Keep a backup of your secret key in a safe place and protect the device and browser where it is stored, because whoever has the key controls the account.
Every transaction is signed on your device and sent by the Wallet directly to the Stellar network. We do not hold your funds, we do not transfer crypto-assets on your behalf, and we cannot reverse, cancel or refund a transaction once the network has confirmed it.
12.2 Payments to stores
When you pay a store with REAL8, for example a store that uses REAL8 Gateway, the payment goes directly from your Stellar account to the store’s Stellar account. We are not a party to the sale and we do not receive or hold the payment. Questions about the order, its delivery or a refund are between you and the store.
12.3 The REAL8 API
The API supplies data and supporting functions to the Wallet and to other software, such as REAL8 price information and the payment page that a store can open for an order. Price information is taken from recent trades on the Stellar network. It is indicative, and it is not an offer, a guaranteed price or financial advice. We may limit the number of requests. Functions that need a credential are available only to those we have given one, and we may withdraw it if it is misused.
12.4 Stores that accept REAL8
If you use REAL8 Gateway or the API in your own store, you are responsible for your store, for the Stellar account you configure to receive payments, for your dealings with your customers and for complying with the laws that apply to your business, including tax and consumer law. Refunds to your customers are made by you, from your own account.
12.5 Services provided by others
Some functions of the Wallet connect you to services provided by others, among them the Stellar network, card payments processed by Stripe and cash services provided by MoneyGram. Those services are subject to their providers’ own terms and privacy policies, and some of them are not available in every country. Purchases of REAL8 by card are also subject to our Refund Policy (https://real8.org/en/refund-policy/).
12.6 Availability
The Wallet and the API are provided as they are and may change, be interrupted or be discontinued. Your account exists on the Stellar network and not in the Wallet, so with your secret key you can reach it through any other compatible wallet.
13. Crypto-asset marketing communications
Communications that promote REAL8 or its purchase, on this website and elsewhere, carry the statement required by Article 7 of Regulation (EU) 2023/1114 (MiCA): “This crypto-asset marketing communication has not been reviewed or approved by any competent authority in any Member State of the European Union.
